Affiliate Policy

Joining the Program

Clients of Network Dynamics can join our affiliate program at any time.

If you’re not yet a client, you can join the program by signing up here or by contacting us via phone or email.

Earning Commission

• You earn $25AUD for each website hosting referral.
• You earn $50AUD for each dedicated server referral.
• We a provide a tracking link and banners for your website.
• A 60-day cookie ensures client orders are credited to you within 60 days of their first visit to our website.

Affiliate Responsibilities

As an affiliate, you agree to the following:

• Any artwork used to promote our brand or services must follow our brand guide.
• No commissions on services purchased under your profile or any profile you control.
• Do not use our trademarked brand name in your URL.
• Do not provide deceptive links.
• Paid search campaigns using our trademarked brand name are not allowed.
• Do not use our URL as the display URL in ads.
• Do not use iframes or other methods to place your affiliate tracking cookie without an actual click-through.

Tracking Cookies

• A 60-day cookie will be placed on the visitor’s browser
• Visitors with Javascript disabled or who have deleted or disabled cookies, will not store the cookie.

Commission Payment

• An affiliate account must be created before requesting commissions.
• Commissions are paid only on tracked sales through an affiliate link or notified to us in writing within 30 days of the service being ordered.
• Commissions are paid in AUD to Australian affiliates with an ABN (Australian Business Number) and may cash out to an Australian bank or PayPal account. Affiliates outside of Australia may only use affiliate earnings as account credit at this time.
• The referred account must remain active for at least 90 days.
• Commissions apply only to web hosting services, not domain registrations, SSL certificates, spam filtering, or other products or services.

Minimum Payment Threshold

• You can withdraw funds when your balance exceeds $100.

Taxes

• You are responsible for your own taxes.

Limitation of Liability

Network Dynamics shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your participation in the affiliate program, including, without limitation:

• Loss of Revenue or Profits: We are not responsible for any loss of revenue or profits, even if we have been advised of the possibility of such damages.
• Loss of Data: We are not responsible for any loss of data or any damages arising from the loss of data.
• Loss of Business or Goodwill: We are not liable for any loss of business or goodwill that may result from participating in the affiliate program.
• Third-Party Actions: We are not responsible for any actions or damages caused by third parties, including but not limited to, issues with tracking cookies, technical failures, or actions taken by referred clients.

Our total liability to you for any claim arising out of or in connection with this agreement or the affiliate program shall not exceed the total commission fees paid or payable to you under this agreement.

Indemnification

As an affiliate, you agree to indemnify, defend, and hold harmless Network Dynamics, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees and expenses, arising out of or in any way connected with:

• Your participation in the affiliate program.
• Any violation of these terms.
• Any violation of applicable laws or regulations.
• Any infringement of any intellectual property or other rights of any person or entity.

Termination

Either party can terminate this agreement at any time with written notice. Upon termination, you must cease using all promotional materials provided by Network Dynamics and remove any links to our website. Any outstanding commissions will be forfeited.

Final Provisions

• Amendments: Network Dynamics reserves the right to amend these terms at any time.
• Governing Law: This agreement shall be governed by and construed in accordance with the laws of Victoria, Australia.
• Dispute Resolution: Any disputes arising out of or related to this agreement shall be resolved via our complaints policy.
